Welcome to Tintly ("Company", "we", "our", "us"). These Terms of Service ("Terms", "Agreement") govern your access to and use of Tintly's website and services (the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
You retain full ownership of any color palettes, configurations, or code snippets you generate using Tintly. We grant you a perpetual, worldwide, royalty-free license to use said outputs for personal or commercial projects.
The Service itself (excluding user-generated content), including its original code, design, features, and functionality, are and will remain the exclusive property of Tintly and its licensors.
To access certain features of the Service, you may be required to register for an account via Google Authentication. You must provide accurate information and keep your account details up to date.
We may suspend or terminate your account for any breach of these Terms.
Payments are securely processed by Dodo Payments. We do not collect or store full payment card numbers or CVC codes. Dodo Payments processes such data on our behalf as our payment processor.
Paid subscriptions renew automatically at the end of each billing cycle unless cancelled. You can cancel renewal at any time from your account or by contacting us at the email below; your access will continue until the end of the current paid period.
If a trial is offered, you will be charged at the end of the trial unless you cancel before the trial ends.
Fees are exclusive of taxes, duties, and governmental charges (collectively, "Taxes"), which you are responsible for, unless we state otherwise. We may change prices or features of plans from time to time; changes will apply on your next renewal after notice.
Unless required by law, all fees are non-refundable and non-cancellable once the period begins. If you believe a charge is in error, contact us within 14 days.
Initiating a chargeback may result in immediate suspension of your account. Please contact us first to resolve billing issues.
You agree not to misuse the Service. Prohibited conduct includes:
The Service may rely on or link to third-party services such as Supabase (database/auth), Google (identity), Dodo Payments (billing), and GoatCounter (analytics). Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services.
From time to time we may offer beta or experimental features. Such features are provided "AS IS" and may be modified or discontinued at any time.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
To the fullest extent permitted by law, in no event will Tintly, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses, arising from or relating to your use of the Service.
Our aggregate liability for any claim relating to the Service shall not exceed the greater of: (a) the amounts you paid to us for the Service in the three (3) months preceding the event giving rise to the claim, or (b) USD $50.
You agree to defend, indemnify, and hold harmless Tintly and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any third-party right.
These Terms are governed by the laws of Ethiopia, without regard to conflict of law principles. Any disputes shall be brought in the courts located in Ethiopia, and you consent to their jurisdiction.
We may suspend or terminate your access to the Service immediately, without prior notice, for any breach of these Terms or if we discontinue the Service. Upon termination, your right to use the Service will immediately cease.
Sections that by their nature should survive termination will survive (including ownership provisions, warranty disclaimers, limitations of liability, and indemnity).
We may modify or discontinue the Service (in whole or in part) at any time. We may also update these Terms from time to time; the updated Terms will be posted on this page with an updated "Effective Date." Your continued use constitutes acceptance of the updated Terms.
Severability: If any provision is unenforceable, the remaining provisions remain in effect.
Assignment: You may not assign or transfer this Agreement without our consent. We may assign this Agreement without restriction.
Waiver: Our failure to enforce any provision is not a waiver of our right to do so later.
Entire Agreement: These Terms constitute the entire agreement between you and Tintly regarding the Service.
Force Majeure: We are not liable for delays or failures due to events beyond our reasonable control.
